my buyers have been delaying to sign my service fee agreement and eventually don’t want to sign. Please advise
Hi Anybody can advise me on the following.
First, while I’m collecting $1k HDB deposit from my buyer, I requested him to sign my service fee agreement. He said he’ll sign my service fee agreement when he exercise the option to purchase.
Then, when I failed to convince seller to let them have the key of the flat and renovate the apartment before the sale completion. They even want to charge their rental on me if they incurred rental due to the delay of the renovation. He sms me and followed by phone call won’t pay me service fee.
While exercising the Option to Purchase, I requested them (husband & wife) to sign my service fee agreement, he said will pay me definately if after the 1st HDB appointment, I can liase with his contractors and the seller to let the contractors access the flat for the renovation quotation purpose,before the sale completion. So that they can get the renovation quotation early.
But, on Sat (2/2/08) evening which just after 1 day of exercise the Option to Purchase . They out of sudden sms me to request for 2nd viewing on Sun 4.30pm.The date they requested is so rush and the seller has Chinese New Year reunion dinner with the family and unable to do it. My buyers got furious and again sms and called me to tell me that they are not going to pay me for the seller can’t let them access to the apartment on the date and time they requested.
I only got sms from the buyer, which he wrote won’t pay me sms as everything he requested can’t be done. Their unsatifation of my service are:- 1. not able to convince the seller to let them have the key and renovate the flat after 1st appointment, 2.the date they requested for appoinment, seller can’t make it..But, they didn’t put into account that the date given by seller they can’t make it. They can’t accept when the things they want being requested to change or rejected.
I don’t have service agreement signed by him. What action can I take to recover my service fee? They keep saying their agent friend didn’t collect service fee from her buyer. He called me and said will asked his agent friend who has 10 years over experiences in HDB to liase with me in future and they will not pay me and won’t talk to me anymore.
Kindly advise how shall I handle this kind of unreasonable buyers. I have from my boss if they don’t sign my service fee agreement, I can’t go to Small Claims Tribunal. And all other agents said count yourself bad luck, no way to deal with them.
I feel that work as a realtor has no protection at all. I have been all the times just listen to his scolding, shouting…..just don’t want to make thing more difficult. But, after they have exercised the Option to Pucrhase, they just find a unreasonable excuse which beyond my control as seller has reunion dinner and unable to go all the way to let them haw 2nd view, they claimed that my service no good and just don’t pay.

Doesn’t this answer your own questions? You have not agreement signed.
The bottom line is you need to have clients sign contract before you start the service.
If you start giving your service before you have a contract you are only causing yourself a disservice.
