Tenants are wanting to leave with a 1 week notice and have rent due back to them. Are we required to issue it?

They are month to month renters. They are constantly late and we issued a 60 day notice to be out by June 1st. They told us today they want to move next week and us give them back 2 weeks of rent. Is that required of us? Or do they still have to give us required notice?

I think you owe them the rent back.
They need to give you 30 days notice. Not 7 days. Dont give them anything because renters that are constantly later usually trash the apartment.
As month to month renters, I’m assuming there is no lease.
However since you gave them proper eviction notice, if they choose to move out in the middle of the month, then they default on the remainder. This is the law in Indiana anyway, where I own rental properties.
NOPE NO MONEY back and it is legal.

What did the original lease require? 30 days, or 2 weeks?
If 2 weeks, then you will have to give them 1 week back. If 30 days, you owe them nothing.

In fact: You should go into the property and take pictures of the place. Sign, date and time those photos. THEN break the news to them - in writing.

laws specific to month to month tenancy prevails…most states it’s 30 days….NO you do not have to give them rent back….but make sure you do an exit walk thru and know exactly how long you have to return any portion of their deposit…
They are obligated to pay rent for 30 days from the date they give notice…..so if they want to leave early….that’s their choice, but the tenancy is still in tact…..NOW, if you rerent the place w/in that “2 week” window….you DO have to pay them the pro rata portion of rent when the place was actually occupied by new tenants…
Legally, I think you are not required to give them anything back.
On a practical note do you want them in your property steaming at you? Do you want a physical confrontation?
Perhaps you should look at as cost of getting rid of bad tenants.
Sweeten the deal. Give them the whole month back if the place is marginally acceptable on their leaving.
