On a practical note do you want them in your property steaming at you? Do you want a physical confrontation? Perhaps you should look at as cost of getting rid of bad tenants. Sweeten the deal. They are obligated to pay rent for 30 days from the date they give notice.....so if they want to leave early....that's their choice, but the tenancy is still in tact.....NOW, if you rerent the place w/in that "2 week" window....you DO have to pay them the pro rata portion of rent when the place was actually occupied by new tenants... laws specific to month to month tenancy prevails…most states it’s 30 days….NO you do not have to give them rent back….but make sure you do an exit walk thru and know exactly how long you have to return any portion of their deposit…

However since you gave them proper eviction notice, if they choose to move out in the middle of the month, then they default on the remainder.
